1. Who is Chocolaty.in?

Chocolaty.in is website from CHOCOLATY PRIVATE LIMITED which is registered with government of Haryana. This page contains all terms and conditions that stand for all orders placed on this site.

 2. Delivery Timings:

For the same day delivery, the order must be placed by 5:00 pm. Orders made after the stipulated time would be transferred to next day. We do promise for on time deliveries to you but we do not guarantee any timely delivery. Our regular delivery timing follows between 9:00 am to 7:00 pm. You can request for special deliveries by filling the Special Instructions section of payment form. But we do not assure for the same if it is not attained. 

In some specific circumstances our delivery might be delayed like extreme weather conditions, riots, strikes, elections, bandhs, during rush hour days like Valentine's Day, Mother’s Day, Rakhi, New year Eve etc., and the order too may not stand cancelled. We guarantee you midnight deliveries on Valentine’s Day between 10 PM to 12 AM

3. Discounts:

 All the discounts are decided by Chocolaty team and we do not club discounts and offer together.

4. Address Change:
Change in the address would be accountable only for 48 hrs before the actual delivery and that is free of cost. Any changes done after the expected time would not be held liable and the order would not be cancelled. After the dispatch of gifts from our end the change in address would not be considered.

 5. Order Change:

Any changes if required on the order placed by you would stand valid if you let us informed within 48 hrs of the actual delivery. If the changes are made after the stipulated time, it would not be considered. Cancellation charges are up to 5% on all the cancellation of orders.

6. Delivery Product:
we do not guarantee the exact replica of the bouquets displayed on the website due to our tie ups with different vendors and season constraints. The quantity of flowers mentioned in the product description would be same. If in case we alter the flowers or substitute with one another it would be of same quality or price with the one it would be replaced. We may even change the color of flowers as per availability. The icing and design of the cake as shown in the website may too vary as per local availability

7. Damaged deliveries:
 Any damage in the delivery would be entertained within 24 hrs of delivery. The complaint lodged must be supported with the substantial proof for the authenticity of the matter.

 8. Rules for delivery:

We deliver as per the delivery instructions provided to you on the website. We deliver the product to recipient only and if found on the delivery that recipient is not available and refuse to accept the delivery. We account that the order to be delivered in such circumstances.

We deliver the order only ONCE, the non-availability of recipient on the delivery would not be deterred and you would be charged accordingly. We will consider the order executed in the below cases:
1. Wrong shipping/delivery address. 

2. Recipient not available. 

3. Premises locked. 

4. Wrong landlines / Mobile number or Extension number which may render us unable      to reach the recipient for the delivery. 

5. Recipient refusing to accept the delivery. 

6. Delivered the product at the Gate/ Reception/ Neighbor. 

 9. Substitution Policy 

Sometimes due to non-availability of the desired the product which is depicted on the website, we substitute the flowers of equal and same worth. We do not compromise with the style, theme and the arrangements of the bouquet. We affirm you the availability of exact number/ quantity of flowers as mentioned in the product description although.

 10. Rules for Duplicate Orders:

In case of the duplicate order placed by you, we would enquire you for the same. If we contacted you and the numbers was not reachable or in case of no response the decision of order is layed in our hands.

 11. Dealing with Fraudulent Customers:
Any fraudulent behavior observed from the clients end like mentioning of wrong address, unethical message, odd delivery timings or any other reason. The order stands cancelled and we withhold the right to block such customers.

 12. Rules for unfounded recipient:

We strictly follow our guidelines and the delivery is intended to be delivered to the recipient only. If the recipient is not found we consider the delivery to be executed and no refunding of the amount would be done thereafter. Please refer to our cancellation and refund policy for further details.

13. All the couriers are delivered through bluedart or of the same worth Courier Company. We do not specify any delivery time or date as it may vary due to several reasons. All the orders are tentatively delivered between 9 am - 7 pm and may take 3-9 days of shipping time depending on the product, availability and other validations. 

 14. We may be allied or associated with any business unit, organization, institutions etc. by our choice. We can even deny the service to any individual, organization and institution by our own wish without stating any reason.

 15. Chocolaty.in may amend its Terms & Conditions if required from time to time. These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Karnal. 

16. These Terms and Conditions, together with Chocolaty. in cancellation and refund policy, Privacy Policy, Disclaimer and other rules and policies posted on the site, which are hereby incorporated as if set forth fully in these Terms and Conditions, constitute the entire agreement between you and Chocolaty.in with respect to your use of and material available on the site, and they supersede all prior or contemporaneous communications and proposals between you and Chocolaty.in with respect to this site. Any rights not expressly granted in these Terms and Conditions are reserved.
